Preparation of Preliminary Amendments for Patents Translated from French

Purpose

When a patent application prepared and filed under the Patent Cooperation Treaty (PCT) enters the US national stage, the application must be accompanied by a translation into English (see 35 USC 371(c)(2) and USPTO MPEP 1893.01(d)). This translation must be accurate and complete (e.g. text in the drawings must be translated); this is the responsibility of the translator. A translation that includes additions or modifications is not acceptable; this includes modifications that do not add new subject matter even changes as minor as adding headings that were not present in the PCT application. These changes are to be made with a separate preliminary amendment. The purpose of this service is to prepare such a preliminary amendment to accompany the translation in order to correct informalities that might otherwise lead to an objection during patent examination. For example, patent applications drafted in France in French follow practices and conventions that will lead to objections when they are examined in the US unless they are corrected first. Most French patent applications have multiply dependent claims depending from other multiply dependent claims; this is not allowed in US patent applications.

I am both a master translator and a registered Patent Agent so I may prepare translations of patent applications drafted in French and prepare a separate preliminary amendment of the patent application for filing with the USPTO.

Scope

Offered as a companion to translation of a PCT patent application for entry into the US national stage, this service identifies and corrects these informalities leading to preparation of a document that can be filed as a preliminary amendment. Attention is given to claim construction and mapping, multiple dependencies are eliminated, incorrect reference numbers are corrected, the specification is revised to meet MPEP 608.01, patent drafting issues related to grammar and to semantic clarity (identified during translation and which were accurately translated) are corrected.

This service does not include looking for possible grounds for rejection, searching for prior art, and consulting prior art identified in the patent application, the International Search Report or reported by the applicant. The disclosure including the claims is not substantially revised or rewritten. Services of this kind may be available separately subject to definition and agreement.
